Gordon Nardell QC joins Northern Ireland Bar for renewables dispute

Energy specialist Gordon Nardell QC has been granted temporary call to the Bar of Northern Ireland to appear in a renewable energy dispute in the High Court in Belfast. Gordon acts for independent renewables operator RES UK and Ireland Ltd. RES has brought judicial review proceedings against Northern Ireland’s Planning Appeals Commission. The Commission dismissed an appeal by RES against a decision by Derry City and Strabane District Council to refuse consent for a proposed seven-turbine wind farm at Bar Cregg, an upland location outside Derry City. The application for judicial review raises issues about the proper interpretation of the Northern Ireland Executive’s policies on the impacts of renewable energy development on the natural environment, and about the duty of a decision-maker to give reasons. A judge is expected to decide in October whether to give leave for the case to proceed.  Gordon is instructed by leading Belfast commercial firm Carson McDowell. Landmark Chambers’ Scott Lyness, a dual-qualified English/NI barrister, is instructed as junior.
