The Unwired Planet International Ltd v Huawei Technologies Co Ltd [2017] EWHC 2831 (Pat)

The Unwired Planet v Huawei is the leading English case on FRAND royalties, arising in a major dispute about telecommunications licensing.

After the decision in Unwired Planet's favour at the trial this year, Huawei sought to bring parallel litigation in China relitigating many of the same issues.

Unwired Planet brought an application for an anti-suit injunction, instructing Thomas Raphael QC, in order to bring the Chinese litigation to a halt.This important application was successful in achieving the desired result and Huawei were compelled to give undertakings to stop the duplicative Chinese litigation before the hearing.

The remaining conflicts were about costs and Unwired Planet were successful on the costs debates, which turned on the effect of prior compromise settlements in relation to costs. A very significant interim payment was awarded, the Judge having considered the merits of the underlying applications.
